## How this works

* Information, not advice. Nothing here says whether a claim will be paid; your policy's terms govern.
* Claim-deadline rules are shown only where the law was read on 2026-09-15: Florida (Fla. Stat. §627.70132), Oklahoma (36 O.S. §1250.5(7), quoted in the Oklahoma Insurance Department's Bulletin 4-2022) and Texas Windstorm Insurance Association (TWIA) policies (Tex. Ins. Code §2210.573, which is subject to Section 2210.205(b), a section this check didn't review). Texas's 61-day notice (Tex. Ins. Code ch. 542A) comes before a lawsuit and isn't a claim deadline.
* Contractor deductible-waiver and rebate bans are shown for Texas, Florida, Colorado, Oklahoma, Nebraska, Minnesota and Louisiana. Colorado's wording comes from an unofficial copy of the statute because the official site blocked access; Nebraska's comes from its Department of Insurance.
* Every other state gets the same two steps: check your policy's reporting requirement, and contact your state insurance department. No rule is shown for a state until it's verified.
* Deductible in dollars = percentage ÷ 100 × dwelling coverage (Coverage A), rounded to the dollar. It follows the North Carolina Department of Insurance's example: a 2% deductible on a home insured for $300,000 is $6,000\. Your policy defines what the percentage applies to.
* Help-line numbers were copied from each department's own page or guide on 2026-09-15.

Information, not legal or insurance advice. The rules shown were read on 2026-09-15 and can change; your policy and your state insurance department have the final word.

## Common questions

### Is there a deadline to file a roof insurance claim?

It depends on your state and your policy. Florida requires notice within 1 year after the date of loss, or 18 months for a supplemental claim. Oklahoma requires a policy with a time limit to allow wind or hail roof claims up to 24 months after the loss when the damage isn't evident without an inspection. Texas sets a one-year deadline for TWIA policies. Everywhere else, and for other Texas policies, check your policy's reporting requirement.

### Is the 61-day notice in Texas a claim deadline?

No. Texas Insurance Code §542A.003 requires written notice at least 61 days before filing a lawsuit over a claim. It's a step before suing, not a deadline for reporting damage, and chapter 542A doesn't apply to an action against TWIA.

### Can a roofer pay or waive my deductible?

In Texas, Florida, Colorado, Oklahoma, Nebraska, Minnesota and Louisiana, state law bars contractors from offering to pay, waive or rebate it; each state's result names the law. This check doesn't list the rule for other states, so ask your state insurance department.

### How do I work out a percentage deductible in dollars?

Multiply the percentage by your dwelling coverage (Coverage A); both are on your policy's declarations page. The North Carolina Department of Insurance's example: a 2% deductible on a home insured for $300,000 is $6,000\. Your policy defines exactly what the percentage applies to.

### Does this tell me whether my claim will be paid?

No. It's information, not advice. Whether a claim is paid depends on your policy and the facts of the loss. Your insurer and your state insurance department can answer questions about your claim.
